  • Digital content: data not supplied on a tangible medium, including repair manuals, OEM information and access to the Lohuis TSB database.

Article 3 – Applicability

3.1 These general terms and conditions apply to every offer made by Lohuis and to every contract concluded between Lohuis and a customer via the webshop, by email or by telephone.

3.2 In addition to these terms, the Return and Refund Policy, the Shipping Policy and the Privacy Policy of Lohuis apply. In the event of any conflict, these general terms and conditions prevail, except where mandatory consumer law provides otherwise.

3.3 General terms and conditions of business customers (purchasing conditions) are expressly rejected.

3.4 Deviations from these terms are only valid if confirmed by Lohuis in writing (including by email).

3.5 Provisions that apply exclusively to consumers or exclusively to business customers are marked as such. Where these terms are stricter than mandatory consumer law permits, the statutory rules apply to consumers.

Article 4 – Offer and prices

4.1 All offers are without obligation. Lohuis may amend or withdraw an offer as long as the customer has not yet accepted it.

4.2 Prices are shown including and excluding VAT. At checkout, the applicable VAT is calculated on the basis of the delivery address. For business customers in other EU member states with a valid VAT identification number verified in VIES, the delivery may be made as an intra-Community supply at 0% VAT; the customer is responsible for the accuracy of the VAT number and company details provided. VAT on an order that has already been invoiced cannot be corrected afterwards.

4.3 Shipping costs are stated separately during the ordering process and are set out in the Shipping Policy.

4.4 Obvious mistakes or errors in the offer (such as a price that is clearly wrong) do not bind Lohuis. In that case, Lohuis will contact the customer, who may cancel the order free of charge.

4.5 Images are as accurate a representation of the products offered as possible. For OEM parts, the packaging or appearance may differ from the photo as long as the part supplied corresponds to the stated part number.

4.6 The customer is responsible for choosing the correct part on the basis of the stated part number, chassis number or application. If in doubt, Lohuis recommends contacting us in advance.

Article 5 – Formation of the contract

5.1 The contract is formed when the customer accepts the offer and meets the conditions set. Lohuis confirms the order by email.

5.2 Lohuis may refuse an order or make it subject to additional conditions, for example in the event of suspected fraud, previous non-payment, or where a product is intended exclusively for professional use and the customer turns out not to be a garage. The customer will be informed as soon as possible and any payments will be refunded.

5.3 The Digital Service Plan and TSB access are intended exclusively for garages and professional automotive technicians. By ordering these products, the customer declares that it is acting in a business capacity.

Article 6 – Payment

6.1 Payment is made using the payment methods offered in the webshop (including iDEAL, Bancontact, credit card and other methods supported by our payment provider). Orders are only processed after receipt of full payment, unless otherwise agreed in writing.

6.2 Business customers may order on invoice by arrangement. In that case, a payment term of 14 days from the invoice date applies. If the term is exceeded, the business customer owes statutory commercial interest and extrajudicial collection costs without further notice of default.

6.3 The customer must report any inaccuracies in the payment or billing details provided without delay.

Article 7 – Delivery and retention of title

7.1 Delivery takes place at the address provided by the customer. Delivery times are indicative. Orders for products in stock that are placed and paid for before 12:00 noon on a working day are, in principle, shipped the same working day. See also the Shipping Policy.

7.2 For consumers, a maximum delivery period of 30 days applies unless otherwise agreed. If this period is exceeded, the consumer may terminate the contract free of charge and will receive the amount paid back within 14 days.

7.3 The risk of damage or loss passes to the consumer upon delivery to the consumer or to a third party designated by the consumer. For business customers, the risk passes upon handover to the carrier.

7.4 All products delivered remain the property of Lohuis until the customer has paid everything owed under the contract.

Article 8 – Right of withdrawal (consumers only)

8.1 A consumer has the right to withdraw from the contract for physical products without giving any reason within 14 days of the day on which the consumer (or a third party designated by the consumer) received the product. For an order with several shipments, the period starts upon receipt of the last product.

8.2 The consumer withdraws through their customer account on the website (Returns page) or by email to info@lohuissolutions.nl. The return conditions, the deduction of any loss in value and the refund are set out in the Return and Refund Policy, which forms part of these terms. The model withdrawal form can also be found there.

8.3 The right of withdrawal does not apply to:
a. services (ECU cloning, Digital Service Plan) after the service has been fully performed, provided performance began with the consumer's express prior consent and the consumer declared that they waive their right of withdrawal once the service has been performed;
b. digital content not supplied on a tangible medium (repair manuals, OEM information, TSB access) once supply or access has begun with the consumer's express prior consent and the consumer has declared that they waive their right of withdrawal;
c. products made to the consumer's specifications or clearly personalised (custom work or items ordered specially for the customer that are not part of the standard range).

8.4 The right of withdrawal is not lost by opening the packaging. However, Lohuis may charge for any loss in value if the consumer has handled the product beyond what is necessary to establish its nature, characteristics and functioning. A part that has been fitted, connected, programmed or coded, or that has come into contact with oil, can generally no longer be sold as new; the loss in value may then amount to the full price.

8.5 If the return seal of a product has been broken, Lohuis can no longer establish the condition of the product or whether it has been programmed or coded. Lohuis therefore regards a broken return seal as handling beyond what is necessary to inspect the product. Lohuis will accept the product, inspect it and charge for the loss in value established; for cameras, control units and mechatronics this may amount to the full price. The consumer will receive a substantiated statement of this.

Article 9 – Returns by business customers

9.1 Business customers have no right of withdrawal. Returns by business customers are only possible after prior registration through the customer account on the website and approval by Lohuis.

9.2 Lohuis only accepts returns from business customers of unused products in unopened, undamaged original packaging with the return seal intact, registered within 14 days of delivery. Products with a broken return seal and electronic and hydraulic components (including mechatronic parts, cameras, solenoids, sensors, control units and accumulators) whose packaging has been opened will not be accepted.

9.3 For an accepted return by a business customer that is not the result of an error by Lohuis, Lohuis may charge a handling fee of 10% of the product price (minimum €15.00 excl. VAT). Return shipping costs are borne by the business customer.

Article 10 – Warranty and conformity

10.1 Lohuis guarantees that products conform to the contract, the specifications stated in the offer and the reasonable requirements of soundness. Consumers are entitled to the statutory guarantee of conformity; this is not limited by the provisions below.

10.2 Lohuis grants business customers a 12-month warranty on manufacturing and material defects, calculated from the date of delivery. The warranty on OEM parts never exceeds the warranty granted to Lohuis by the manufacturer or supplier.

10.3 Repair kits and individual mechatronic parts are intended for fitting by a competent technician with the correct equipment. The warranty does not cover defects resulting from:
a. incorrect, unprofessional or incomplete fitting, or fitting contrary to the supplied or factory instructions;
b. failure to replace additional parts prescribed for the repair (such as filters, seals or oil) or the use of incorrect oil or fluids;
c. failure to carry out the required adaptation, calibration or learning procedures with suitable diagnostic equipment;
d. an incorrect diagnosis, as a result of which the part supplied does not remedy the actual cause of the fault;
e. defects in the vehicle or other components that damage the part supplied (for example contamination, metal debris or electrical faults elsewhere in the system);
f. normal wear and tear, accident, overloading, tuning or use in motorsport.

10.4 A warranty claim must be submitted via info@lohuissolutions.nl, stating the order number, a description of the complaint, fault codes and, where applicable, photos or a diagnostic report. Lohuis may require the part to be sent in for assessment. If the warranty claim is justified, Lohuis will, at its discretion, repair, replace or refund. For consumers, the statutory order of repair or replacement, followed by price reduction or termination, applies.

10.5 The manuals and fitting overviews supplied are an aid and do not replace the knowledge and judgement of the technician carrying out the work. Lohuis tests products and manuals itself but cannot rule out that a repair on a specific vehicle may proceed differently.

Article 11 – ECU cloning

11.1 In ECU cloning, Lohuis copies the data (including software, coding, immobiliser data and VIN) from an original ECU supplied by the customer to a donor ECU supplied by the customer. Lohuis does not supply ECUs unless expressly stated in the offer.

11.2 The customer is responsible for supplying a suitable donor ECU whose part number (and, where applicable, hardware and software version) exactly matches the original ECU. The customer packs the ECUs properly and states the order number.

11.3 The customer declares that they own the vehicle from which the ECUs originate, or have the express permission of the owner, and that the ECUs do not come from a stolen vehicle. Lohuis may request a copy of the vehicle registration certificate or an order confirmation from the vehicle owner and may refuse the order if there is any doubt about this.

11.4 Lohuis treats the data read out as confidential and uses it solely to carry out the order.

11.5 The ECUs are sent to Lohuis using the shipping label provided by Lohuis (within the Netherlands). Return shipment to the customer is included in the price. Lohuis is not liable for loss or damage in transit, except to the extent that the carrier compensates such damage.

11.6 Lohuis cannot guarantee that every ECU can be read or cloned. If cloning proves technically impossible for a reason attributable to the ECUs supplied (for example a defective, damaged, protected or non-identical ECU), Lohuis will charge an inspection fee of €49.00 excl. VAT (€59.29 incl. VAT) and refund the remaining amount. In that case, the ECUs will be returned to the customer.

11.7 Lohuis is not liable for the consequences of defects in the donor ECU supplied by the customer, for a vehicle not functioning if the fault is not caused by the ECU, or for any software modifications (tuning) present in the original ECU that are carried over during cloning.

11.8 For consumers: by placing the order, the consumer expressly agrees to performance before the end of the cooling-off period and waives the right of withdrawal once the service has been fully performed. If the order is withdrawn before Lohuis has started the work, the full amount will be refunded.

Article 12 – Digital Service Plan (account registration with manufacturer portals)

12.1 Under the Digital Service Plan, Lohuis applies for and sets up a business account on behalf of the customer with the official repair and maintenance information portal of the relevant manufacturer or importer (including erWin for Volkswagen, Audi, SEAT/Cupra and Škoda; the BMW/MINI portal; the Mercedes-Benz/Smart portal), so that the customer can view the digital service history and register maintenance themselves.

12.2 The Digital Service Plan is available exclusively to garages. By ordering, the customer declares that it is a garage registered in the trade register (or a comparable foreign register) and authorises Lohuis to carry out the registration with the portal on its behalf, to enter the company details required for this and to accept the portal's terms of use on its behalf.

12.3 The customer is responsible for the accuracy and completeness of the data supplied (company name, Chamber of Commerce number, VAT number, address, email address, contact person). Some manufacturers impose additional requirements, such as a valid VAT number or additional verification; the customer will cooperate with these in good time.

12.4 Lohuis is not a party to the contract between the customer and the manufacturer or importer. The content, availability, functionality and any usage costs of the portal are determined by the manufacturer and may change. Costs charged by the manufacturer or importer for the use of the portal are borne by the customer, unless stated otherwise in the offer.

12.5 The Lohuis service is complete once the account has been created and the login details or activation instructions have been provided to the customer. The purchase price relates to the registration service and is a one-off payment; Lohuis does not provide a subscription.

12.6 If the manufacturer refuses the registration for reasons not attributable to the customer, Lohuis will refund the full amount. If the manufacturer refuses or terminates the account because of incorrect data provided by the customer or because the customer acted in breach of the portal terms, there is no right to a refund.

12.7 If the Digital Service Plan is exceptionally ordered by a consumer, Article 11.8 applies accordingly.

Article 13 – Lohuis TSB (technical database)

13.1 Lohuis TSB is an online database containing diagnoses, technical product information, diagrams and solutions for faults. Access is granted to the email address used to order; login is by means of a one-time code sent by email. The account is personal to the customer's business and may not be shared with third parties outside that business.

13.2 Access is granted for the period stated in the offer. During a free promotional period, Lohuis may terminate access at any time or convert it to a paid model; existing paid access continues until the end of the paid period.

13.3 The content of Lohuis TSB is intended to support diagnosis and repair by professionals and does not replace factory information or one's own investigation. Part of the content is supplied by users and is not checked in advance by Lohuis. Lohuis gives no guarantee as to accuracy, completeness or applicability and accepts no liability for damage resulting from the use of the information, except in the event of intent or deliberate recklessness on the part of Lohuis.

13.4 Users who post solutions, photos or documents themselves guarantee that they are entitled to do so and that the content does not infringe the rights of third parties or statutory regulations. The user grants Lohuis a non-exclusive, worldwide, royalty-free licence to use, edit and display the posted content to other users within Lohuis TSB and in related products (such as manuals). Lohuis may refuse, modify or remove content without giving reasons.

13.5 It is not permitted to copy the database or parts of it, to download it for reuse outside one's own business, to scrape it, to resell it or to make it public. In the event of misuse, Lohuis may block access immediately without any right to a refund.

13.6 For consumers: by ordering access, the consumer agrees to immediate supply of the digital service and waives the right of withdrawal once access has been activated.

Article 14 – Repair manuals and OEM information (digital content)

14.1 Repair manuals, fitting overviews, wiring diagrams and OEM information are supplied digitally (download or access via the customer account). The customer receives a non-transferable licence for use within its own business. Reselling, sharing with third parties, publishing or using them to compile one's own commercial documentation is not permitted.

14.2 The manuals have been compiled with care and tested in practice by Lohuis, but carrying out a repair remains the responsibility of the technician. Lohuis is not liable for damage resulting from following a manual, except in the event of intent or deliberate recklessness.

14.3 For consumers: by starting the download, the consumer agrees to immediate supply and waives the right of withdrawal.

Article 15 – Liability

15.1 Towards business customers, Lohuis is only liable for direct damage resulting from an attributable failure, and per event up to a maximum of the invoice amount of the order concerned (excluding VAT and shipping costs).

15.2 Towards business customers, Lohuis is not liable for indirect damage, including consequential damage, fitting and removal costs, costs of replacement transport, vehicle downtime, lost turnover or profit, damage to other vehicle parts and damage caused by incorrect diagnosis or fitting by the customer or third parties.

15.3 The limitations in this article do not apply to damage resulting from intent or deliberate recklessness on the part of Lohuis, nor to the extent that mandatory law (including the statutory rights of consumers in the event of non-conformity and product liability) precludes limitation.

15.4 Towards consumers, Lohuis is liable in accordance with the law. Towards consumers too, Lohuis is not responsible for damage caused because a part was not fitted by a competent technician or not in accordance with the instructions.

Article 16 – Intellectual property

16.1 All rights to texts, photos, videos, manuals, the TSB database and other content of the webshop are vested in Lohuis or its licensors. Use outside the licence granted is not permitted without written consent.

16.2 In the event of commercial reuse of Lohuis content without permission by a business party, that party owes an immediately payable penalty of €5,000 per infringement, without prejudice to Lohuis's right to claim the actual damage. Towards consumers, Lohuis claims the damage actually suffered.

Article 17 – Force majeure

Lohuis is not obliged to perform an obligation if it is prevented from doing so by force majeure, including in any event: disruptions at carriers, suppliers or manufacturer portals, failure of internet, power or software, pandemics, government measures, strikes and extreme weather conditions. If the force majeure lasts longer than 30 days, both parties may terminate the contract for the part not yet performed, without any right to compensation.

Article 18 – Complaints

18.1 Complaints about a product, service or the performance of the contract can be submitted via info@lohuissolutions.nl, stating the order number and a clear description. Complaints are answered within 14 days; if more time is needed, Lohuis will indicate within that period when a substantive reply will follow.

18.2 Business customers must report visible transport damage or discrepancies in the delivery within 5 working days of receipt. Later reports may be rejected if Lohuis can no longer recover the damage from the carrier as a result.

Article 19 – Applicable law and disputes

19.1 All contracts with Lohuis are governed by Dutch law. For consumers residing outside the Netherlands, the mandatory consumer protection provisions of their country of residence continue to apply.

19.2 Disputes with business customers are submitted to the competent court of the District Court of Overijssel (the Netherlands). Disputes with consumers are submitted to the court having jurisdiction by law.

Article 20 – Amendments

Lohuis may amend these terms. An order is governed by the terms applicable at the time the order is placed. The current version is always available on the website.
